In California…First you would have to drive up in your prius then you would have to make sure your stock was made from recycled bamboo. Your shells have to have 99% recycled material and the bullet would have to made from lead free zinc alloy. Once you put on your hemp jeans and your $200 t-shirt you would have to have written permission from the State, County, City, Homeowners Assn (making sure your choice of color rifle was within the CC&R’s and wife. Then maybe the Secret Service would tap your ass as you exited your car.

The article didn't specify whether or not the magzine was loaded in the AR. It refered to a "clip" for the Beretta (gotta love inaccurate descriptions) but again didn't mention if the magazine was loaded, or if there was a loaded magazine in the pistol.
Open unloaded carry is legal in California. Know your distance from schools and other prohibited zones (sounds so Orwellian), but other than that, you could walk into a Trader Joes with a CA legal handgun strapped to your side so long as it's not loaded. As with anything firearm related in CA, know your laws stone cold, and be prepared for encounters with LEO that aren't as well versed in said laws as yourself. You can do it, but I'd have Michel and Associates (formerly Trutanich Michel LLP) or Davis and Associates on speed dial in the event you need legal counsel.
Coz,
The Federal Assault Weapons ban that expired is different than California SB23, which is codified under the various sections of CA penal code 12276. Do a search by my user name here, or in general on calguns.net or thehighroad.org for more information on the legality of semi-automatic centerfire rifles in California.

Don't forget that some counties in California actually do issue permits to carry firearms. I'm thinking you'd probably have to be in Shasta County or somewhere similar, but they do still exist in our state :D
This is actually one area where activist groups are looking to push Heller incorporation. Many counties have essentially been denying carry permits carte blanche, and now those counties are being slapped with lawsuits. :thumbsup:thumbsup With any luck, after the first few go in favor of the pro-2a crowd; more fiscally responsible counties will see the light and re-think their policies prior to being named in a suit.

It was loaded, there was an interview on cnn with the reporter.
Thanks for the info Chris, I brought all my bans with me when I left cali and they're legal here in Az. I don't worry about cali laws anymore unless I'm on the water at the river, and then I don't usually have a folding stock mini-14 with me :D

Ok, I guess I've drifted into the "cobwebs of the mind" group. The 2nd amendment guarantees my right to keep and bare arms. Right? So you're saying Calitaxofornia has taken part of that right away? Illegal to "openly" carry a loaded weapon? Walking down the street with a loaded single shot, shotgun over my shoulder is now ILLEGAL? How can Cal deny my 2nd amendment rights? I was under the impression you could walk around with a revolver on your hip, loaded. I realized this would create a lot of LE interest, but was un aware it was illegal......Has anyone challenged this law in Fed Court?.....Ray

I honestly don't know about California. But is Arizona, it's normal. Many people carry in the open.

Ray, I'm typing this on my phone, so it will be brief. You have touched upon the very essence of the 2A debate in CA. Heller affirms what many state legislators viewed as a gray area with regard to the intent and aplicability of the second amendment. Prior to Heller, 2A advocates argued the forefathers intent with rgard to the second amendment, but there wasn't a definitive Supreme Court ruling/precedent to support the intent many Americans believe our forefathers had in adding the 2nd amendment. Now that Heller is on the books, our right to keep and bear arms for protection as opposed to sport has legal precedent/standing.
Over the next few years many of the travesties that have popped up around firearms ownership will begin to be addressed on an individual basis by pro 2A advocacy groups. The main issue is that local enforcement of firearms related issues has varried due to the lack of a cohesive understanding of the purpose of the second amendment. Now that such a clear interpretation of the amendment exists, firearms legislation and enforcement wil become more uniform from state to state and county to county.

I actually am suprised by who carries here in Az, had a group of scruffy bikers pull up next to me at a light and 3 out of 4 had glocks in holsters, I thought don't cut or piss those boys off

So it's going to take a precedent setting case to blow Cal out of the water concerning "open carry" laws..........I have no hidden desire to walk around armed, but I strongly disagree with any law that says I can't...............Ray

Ray,
what will likely happen is that a few of the pending suits filed against various counties for their failure to facilitate the rights afforded by the second amendment by not processing/accepting/approving carry pemits will guide other counties to immediately revise their attitudes toward carry permits, both open and concealed. This is of course assuming that the suits that have already been filed are successful.
The implications of the Heller decision are wide reaching and will (if the decision isn't reversed) should also lead to the removal of California's Safe Handgun list. Even if you don't want to carry, the statement about not wanting to be told you can't is an indicator that you should get involved in advocacy at some level.. ;)
