Serious question here: What happens if Hillary is elected AND the FBI indicts her in December for CGI malfeasance?

http://www.realclearpolitics.com/vi...ctment_likely_in_clinton_foundation_case.html

Does Obama throw Marshall law out there, does Ryan take over as President since he's the number 3 person, but on transition day, there is no president elect and not sure if the VP elect slots up automatically?

Who knows this shit?

Weiner's molester investigation brought the whole email deal back into focus when they found it's contents to contain Huma's "other" email cache. Mainstream media doesn't want to go there in support of HRC's lies that nothing exists apart from the original quest that the DOJ per the WH stonewalled.

Huma is getting squeezed between a rock and a hard place as she perjured herself by not admitting to using her perverted hubby's laptop. Eventually Huma is going to either fall on her sword, taking her lumps or turn on her boss to avoid jail and worse.

Rudy G pretty well laid the whole deal out on Megan Kelly's show. The CF and pay to play deals HRC abused while in her SoS position are being documented by the email trail and she may have finally ran past her interference into open ground. The FBI core of agents that are actually honest law order citizens, have forced Comey's political "decisions" to be rescinded and we can finally get some justice and end this parasitic governing eating the core out of our nation and Constitution.

I honestly have faith that the system is in the midst of correcting itself from within and even if HRC wins next week, the momentum within the FBI will prevail to render her helpless or even get her impeached.....I don't know how the law is set up for what is being dealt with, and it may not have precedent to steer it, but if all can be brought to the surface unencumbered by inside politics, justice may finally be served.

The Cubs proved last night that nothing is forever, and the Clinton Crime Machine may have finally run out of corruptive luck.....What we need here is a vision of the NWO gnomes in their medieval castle, grumbling about their hillbilly Clinton minions fucking things with arrogance and overconfidence.:skull

U.S. Constitution - Amendment 20
Amendment 20 - Presidential, Congressional Terms

<<Back | Table of Contents | Next>>

1. The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.

2. The Congress shall assemble at least once in every year, and such meeting shall begin at noon on the 3d day of January, unless they shall by law appoint a different day.

3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

4. The Congress may by law provide for the case of the death of any of the persons from whom the House of Representatives may choose a President whenever the right of choice shall have devolved upon them, and for the case of the death of any of the persons from whom the Senate may choose a Vice President whenever the right of choice shall have devolved upon them.

There is a presumption of innocent until proven guilty.

So technically the President Elect would be sworn in and depending upon the outcome of the case, that individual would remain in office until such time as they resigned or were impeached (charged) by the House and convicted by the Senate. In either case, resignation or conviction by the Senate, the VP would become the President and the new President would nominate a new VP that would have to be approved by a majority of the Senate and the House.

But in real life, there is the presumption of dignity. If you are perp walked, after you are elected, do you honestly think you could govern? Democrats think so, everyone else, no.

There are presumptions galore here.

If that is the qualifier, the answer is no, neither candidate if elected will be able to govern effectively.

POTUS could pardon her and everyone else related to the issues at hand, and can even pardon them for crimes not yet charged, even if new evidence/info surfaces.

I think the system "corrected itself" only because they mountain of evidence in Weiner's laptop was impossible to ignore.

Had they not won the lottery with this laptop, it would be business as usual.

Think about this:
Justice granted immunity left and right while allowing people to plead the 5th. Immunity is supposed to be traded for testimony, not silence.

This reeks of everything wrong with government and consolidation of power.

How in the world does the Senate come into play with a treason crime tried by the FBI in the courts?

The senate is as corrupt as every other part of the government, please explain how they get to be involved at all, other than declaring her unfit based upon a guilty verdict?

the way I heard it explained:

If she gets convicted prior to inauguration (assuming she wins), the President can pardon her.

If she get elected first, then the house could vote for impeachment (simple majority) and it goes to the Senate for a trial. If convicted by the Senate, then she can pardon herself.

If Trump gets elected prior to her conviction, she can go to prison.

HE is not implicated in the cover up of the server . He knew about it long before he admitted to it, and there are other 'treasonous acts' contained in the Emails that may include the participation of Obama, his staff, and members of Congress .

This could end up being a "K Mart Blue Light Special" for DC in general, let's hope so .

HRC beats Trump with 330 plus EC votes on November 8th.

On November 9th a court order sealing every single file/record/email/tweet/fart/burp that HRC has ever sent or received goes into effect freezing any and all investigations.

The Senate will be under Democratic control by 3 or so seats leaving the House swinging in the wind. Ryan being smarter than most and having eyes on 2020 will not entertain any talk of impeachment hearings unless there is a 100% guarantee it will be successful... The fight will shift to the Supreme Court Nominees and the Repubs will burn any and all good will they have left with the voting public making the 2018 midterms one of the few times in history a sitting presidents party gains seats in the house.

2020 will see HRC reelected if her health allows leaving 2024 as the next shot the R's have at the oval.

I understand that.
I'm just saying a sitting president has the power to pardon people of crimes they haven't even been charged with.
Basically he could give HRC and her cronies (who are also HIS cronies) a complete pardon, immunity from future prosecution relating to this fiasco.

Obama can't be prosecuted while in office, so he would have to be impeached then charged...that's not going to happen, there simply isn't enough time before his term expires.

in the evidence and he is under 'impeachment proceedings', it would be unprecedented for him to pardon his own co-conspirators . IF he did give any pardons, the day he leaves office, the FBI would already have a warrant for his arrest .

If he is named, the FBI will just wait until he leaves office to get him .

He may just be disgraced for his actions or inactions, but will history know what we know of him now ? That is hard to say .

There are (allegedly) treasonous acts and pedophilia outlined in these new Emails that include the WH and Congress ..........

Two separate issues.

There is nothing in the constitution that prevents a convict from running for or holding the office of the presidency. HRC could be convicted of a felony and yet still remain in office.

As an example, nothing in the Arizona state constitution prevents an individual who is a criminal or who has been indicted for a felony from running for County Sheriff. That is why Joe Arpaio remains on the ballot, and will probably still win despite the indictment. Arpaio supporters don't care.

The way the constitution provides for removing the President from office if they are unwilling to resign, is through an impeachment (accusation) by the house and a trial by the Senate. Without Congress having the ability to get involved, felons could remain President without recourse.

If Clinton was charged and convicted, it would be the first for a president. I know Tyler succeeded Harrison when the later died a few weeks into his first term as president. Tyler finished Harrisons term without a Vice President. I assume if the president is removed, the Vice President moves up. But I doubt it would be easy and turned complex and hotly contested by congress.

The 25th amendment is clear on succession.

Gerald Ford was the only person in America history that served as both VP and President but was never elected to either post. At least if Kaine or Pence became President under the 25th amendment, either would have been elected.

True but the 25th was added in 1967. The Kennedy assassination created a mini constitutional crisis. Tyler was the first Vice President to assume the presidency without being elected. Fords was just more constitutional because his succession so far is the only one done under the 25th. Tyler is sort of ignored because he joined the confederates after his presidency.

.

While he might be able to pardon her on future charges, that wouldn't bind a future legislature from bringing forth impeachment proceeding.

I read a quip yesterday that depending on who gets elected, how fast will the impeachment happen? It'll be either President Kaine or Pence running for (re)election in 2020 if I had to guess.

If Hillary is elected and then legally removed via high crimes and misdemeanors. It will be the biggest constitutional crisis in political history. Even bigger then the scandals in the aftermath of Harding's passing, I.e.: the tea dome scandal. And even greater then Watergate. This will nail the Bushes as well as the Clintons and Obama!

Americans really should be taught American political history from 1813 till now. But that would tarnish most of the presidents, democrat and republican. Hence presidency of people like Harding and even Wilson are totally over looked today.

Weinergate. She'll have that slapped on her forehead for life. Hopefully it also keeps her evil spawn Chelsea out of politics.
