You guys are missing the big picture a police officer gives you a command don't resist pretty simple in my eyes .....
Where did you see he was resisting? He had cuffs on.

Without knowing all of the findings (final autopsy, all of the videos, the incident report etc) it’s impossible to make that legal conclusion.... but maybe I’ll answer it this way.. with what has already been seen, the legal definition of murder has not been met.

True that ME could have some issues we shall see. But I believe as many others he would have lived that day, maybe died a week later but for sure that cop is responsible on that day. Do you think the cop should be proven not guilty, for me and 99.9% of the people in this thread alone feel as I do. Fair Statement or not.

If he didn’t have a counterfeit $20 and tried to use it his would have never happened period!
Did the cop prove that he had used a counterfeit $20 before he killed him?

Ok. There are 2 videos of the arrest. I didn’t see any resistance. Is the posed warrant final. Or can it be changed when more facts come out.

All the cop did was arrest him for breaking the law, it's not the cops fault that he was in poor health and had a stressed induced heart attack.

Even the cops on RDP agree the cop was wrong and should be in jail.

there's a chunk of video/videos missing which i'm sure will surface to answer a lot of questions to how everything unfolded. this is erelevent to the main issue just curious if any of you seen the video of when the "paramedics" arrived i know for sure not in my area of growing up i have never seen emts armed and in body armor kind of strange and zero attention to the man just flopped him over on the board and hauled out of there.

not familiar where the exhaust comes out on the suv but would him being right under it add to the death?

Yes sir most of the country thinks these guys should be convicted of murder on the face of the video alone but that’s not how the criminal judicial system works..

Guilty by public opinion is a far cry than guilty by a jury of your peers

I’ll flip the script and hope that if you were charged with a very significant crime you would utilize your right to a trial and have your right of innocent until proven guilty afforded to you just like the cop

Fair enough, I’m basing on what I saw and you are basing you’re opinion on what you read. But for the record I don’t think that that cop shouldn’t have his day in court. I do know how the justice system works. My gut tells me the reason the other 3 cops haven’t been arrested is that have already rolled over. The DA came out and said, hopefully I’m correct on who it was. But at that time he said he saw nothing was there to arrest the cop, then that changed quickly. Maybe there is a smoking gun none of us know about. But if you believe what the cop did was right then so be it.

4W, will you at least give me that that was excessive. I believe that cop knew what he was doing. Just my take, but I do respect what others opinions are.

Got a little carried away but race doesn't define a person character and integrity do there are assholes in every race from what i gather in this thread this officer had neither. Again how about that beer and boat talk way more fun carry on gentleman.

maybe you need to utilize your abilities in the field of reading comprehension. I never once said, inferred to, alluded to or anything of the sorts that what the cop did was right. i merely indicated that the preliminary autopsy findings that were indicated on the PCD werent necessarily warranting a murder charge. Do you know the legal definition of murder?

Nor did I say the cop that has been charged didn’t deserve his day in court. Kinda stings a little doesn’t it. Yes I do know what the legal definition is , you learn that when you have to go to court when you have 2 friends murdered.

No, like I said in other posts the knee was excessive especially for that length of time, but it appears the knee didn't kill him.

I'm willing to bet he had a stress induced heart attack from being arrested, people die every year from heart attacks while being arrested. It's a very stressful event, I have been on a lot of chest pains calls on people that are in custody some of them had an elevated ST segment which means they are having a heart attack. The cop needs to answer for his actions for sure he was excessive and didn't need to stay on him for any longer than necessary which I believe is just a couple minutes.

the knee did not kill him period. the district attorney would have to convince a jury that the knee applied by the officer killed mr.floyd. the autopsy so far does not support that. you would need a medical finding that supported that and its not there yet.
"Appears" for now, once toxicology and blood tests come back we will have an even better idea of what killed him.

Correct, Floyd was not a model citizen, but to say his death was not caused by that officer is just wrong. He certainly
contributed and pushed it along with his knee on his neck. And to say different just makes things worse.
I had a really hard time watching that video as I am sure others did, no way to defend this cop. My family and father
are Leo, and I am a big supporter, but I see now way of supporting this.

Cops routinely use their knees while restraining a person. Usually dropping hard onto a suspects back while they are being held down on their stomach by others. I have had a overzealous asshole cop with his knee on my head after I was cuffed... I think cops may be trained to use their knees aggressively to get the "upper hand" during an arrest... Face it, some cops get worked up during an arrest. Others want to kill after a vehicle chase ends, (ala Rodney King)... It's human nature to be aggressive when the adrenaline is flowing... I heard a report the cop had over a dozen "excessive force" complaints.... IMO he should have never been a cop, IMO, he IS responsible for the death, and while "Murder" may be a little harsh, he is guilty of some serious shit and should do a bunch of years in general population, AND the other three also need some prison time...
AND, police training should stop allowing the use of the knees, period....

I do not need any proof, I saw the video just like everyone else and guess what, thats good enough for anyone that has a brain.
Maybe not good enough for our screwed up legal system, but good enough for common sense.

I am not sure what your waiting for, but lets spell it out for you. Its called a chain of events.
The perp caused it and the police are called. In the end the cop puts his knee on his neck.
He could have put it on his back. Why the neck? Maybe he is sick and tired of arrresting this
guy. I don't know. Now he is gonna punish him a bit. Pretty sure he did not intend to kill him.
He continued the events which then spiraled out of control. The cop had control of the
situation when the suspect was cuffed and on the ground not restisting, but begging for his life.
The knee in the event caused the chain to end up in the death. Period.
No knee in the neck for 9 minutes, no death. There will probably be 5 different ME reports
with 5 differrent causes of death. Does not change anything unless we do NOT have that
video. The video is the key. Thats our legal system at work. IF you thinks its fair for
everyone, then your smoking crack. This has nothing to do with other countries. I feel like
we all won the lottery for just being born in this great country, but our legal system is not
what it once was. The liberals and big money have really damaged it. Bottom line is that
cop was the cause of death.

You are flat out ignorant about the law, how the criminal justice system works, how evidence works in a jury trial and what needs to be proven or not proven for guilt. I suggest you go volunteer for your civic duty (jury duty) and get some experience in criminal law.

For example, There is only one ME report that can be used by the prosecution in this criminal case. Only 1. Not 5 not anyone else’s.

Another example you are assuming facts that have not been brought forth in evidence. What that means is you are baseing your opinion on what the cop could of done or should of done not was actually done that did not cause death. The knee in the back caused the chain of death????? No piece of evidence presented so far in the media had shown that.

How about the severe health defects mr Floyd had caused the chain of his death??? The knee which caused no injury is just one small component in the larger totalitary event.

There are only three states with third degree murder statutes.

The prosecutor does not have to prove that Mr. Chauvin’s actions were the direct cause of death. All he has to prove is that Mr. Chauvin acted in a way that was “imminently dangerous to others” and that he acted ”without regard for human life. There is no requirement to show the officer either planned or intended to kill, just that his actions were outrageous and led to the death, not necessarily directly caused his death.

For example, in other states a person who leads the police on a chase and a pedestrian is accidentally killed would not be charged with murder in 47 states, but could be charged with 3rd degree murder in Minnesota.

As you state, jury trials are a crap shoot. After all, OJ was found not guilty. Naturally the prosecuters included 2nd degree manslaughter which is simply taking a risk that results in the death of a person. The risk one takes, such as placing your knee on someone‘s neck for 8 minutes and 45 seconds while being repeatedly informed on camera that the dude was unconscious, does not have to be the direct cause of death, just something in the chain. In simpler words, if not for the knee, would Mr. Floyd be dead at that time.

No one knows what happens, but one thing is certain and that is the knee does not have to be proven to be the direct cause of death for a conviction on either of these two charges.
