Judge just handed down sentence. 4.5 yrs for count 1- attempted fraudulent schemes + 3.5 years for count -7 theft to be served concurrently.
Judge reamed him and said that he deserved all that and if it were in his power he would have received much more,

How does the restitution work?
Wages get garnished on a self employed guy....

Court ordered restitution is not the same as a judgement. Restitution has to be paid, and they can seize property to satisfy the restitution claim.

4 1/2 years is still hard time even if he does 1/3 of it. He'll be living in greybar hotel. Even medium security has murderers in it.

No, it means that the douche will file bankruptcy and never have to pay a dime.
I could be wrong but i don't think you can file bankruptcy against a court mandate. Unfortunately collecting on the debt may be challenging.

Yeah look at all the money OJ was suppose to pay the family. as far as i know he hasn't paid one cent. his retirement and house in florida are all protected

looks like the judge handed down the maximum allowed per the plea agreement
this was the agreement presented to him back in march that he accepted. The agreement allows for restitution to the victims, although I do not believe we will see much if anything from him..

i believe restitution is based on income...........just saw a doc on the mcdonalds monopoly scam, they got millions, guy is paying under $200 a month now that he is out........SMH

Arizona restitution information. bankruptcy does not cancel court ordered restitution.

Victim Restitution
If someone is found guilty of the crime committed against you, the court may order that person to pay you the financial costs of your victimization. This court-ordered payment is known as restitution. Victims of crime have a constitutional right to receive prompt restitution. If charges are filed in your case, it is important that you contact your prosecutor’s office of victim services program for more information and assistance with the restitution process.

The Arizona Attorney General’s Office is unique as it has a restitution monitoring program. If you are a victim of a crime in a case prosecuted by the Attorney General’s Office we may monitor your restitution case for compliance. It is important to note that the monitoring program is not an enforcement program but will work with probation officers to try to bring non-compliant defendants into compliance. All court ordered restitution is paid to you by the Clerk of Court. You must keep your name and address current with the Clerk of Court's Office in the county in which the case was prosecuted to ensure you receive payments until the amount of restitution is paid or until the defendant's sentence has been completed.

The Realities of Restitution
Since the defendant has been convicted of a crime his or her employment opportunities and ability to earn money may be limited. Defendant who are paying as much as he or she is able to pay toward their restitution, even if it is an amount lower than ordered, cannot be forced to pay more.

In cases involving multiple victims, restitution is usually disbursed on a pro-rated basis. This means the defendant’s monthly payments will be divided among the multiple victims based on a percentage of the victims loss.

A defendant's term of probation may be extended for up to five years, if convicted of a felony and restitution is not paid in full. If a defendant still owes monies at the end of his or her sentence, a criminal restitution order is filed on any unpaid balances. This order can be enforced in civil court. Unfortunately, the majority of the defendants who are ordered to pay restitution never pay the total amount.

A civil judgment is much different than court-ordered restitution in a criminal case.

Criminal restitution is largely penal in nature, and cannot be discharged thru bankruptcy, especially for fraud related crimes.

Typically a defendant will be required to pay restitution as part of probation upon their release. That's where victims need to stay on top of it since not complying with a court order can land him/her back in prison (theoretically). What happens after probation expires? - it depends how the order from the court is written.

Let’s put some facts and some supposition together with this whole thing so mixing in a bunch of facts with the supposedly things that might’ve happened how about this.
The judge was already upset with
Tim and his lawyer for all of the continuances that they had to make. Tim stiffed his lawyer for payment but the judge would not let his lawyer leave the case so he was stuck
Tim‘s lawyer convinced him that he would probably not serve any time if he excepted the plea.
Tim‘s lawyer knew the judge and knew that he was going to head down the harshest sentence possible.
I don’t know for a fact that any of that is true but it sounds reasonable.

oj has his pension-401k the only one that can touch that is your spouse(she is dead) or ex spouse in divorce..
he can not own any property in his name or anything of value.. my .02 was the goldmans should of let him do his book and then go after the funds...

its nice that pos(tim) got that sentence.. but sad for the folks that lost out on money and boats....

I really have to wonder? Damn guy was all this worth it,What did you really accomplish,other than hurting so many good people and losing everything,your Wife, Company and Most Important Your Reputation/Name.

I have to wonder if he really thought he could pull all this off and everyone would be paid or?

As a member of this forum I am glad I was wrong. I have seen a lot worse receive a lot less. Assuming no previous felonies and fact that he owed a lot of money I would have assumed probation. I bet there was some good victim impact statements that said hell with the money, send him!!

For those of us that have never been to the pokey what is the next two weeks?
Place him in a shared cell. Probably one cell mate. In a block. That block will get open door time to sit and watch tv with others
Everyone will size him up. The shit talk will start. The peckerwoods will start to talk to him, especially with his shaved head.
He will need to lay low, he wont though.
Might not get a beating but he wont sleep or be used to meal schedules.
He will most likely try and be a guards friend, they wont fall for it.

He will find others in there that he can manipulate. They are plenty of targets for him.
He will also try with the wrong one and get a stern reality check.

As he enters they will strip him. Search him. Do some basic assessments to figure out what cell he ends up in. Then give him a pillow and blanket and escort to the cell. The heckling will start then.
His look is not going to help at all. He will be targeted right away as something other than a boat scam artist.

Be a cool reality show. Ha

OJ originally moved to Florida to look for the true suspect (I believe he could own a million dollar home and it could not be touched, at the time at least). You have to have a roof over your head!! :rolleyes:

A bookkeeper that worked for me embezzled $55K. She also kept money that was supposed to be deposited for 941 taxes, which meant she was charged for both crimes by the feds.

She received a six month prison sentence and was ordered to make restitution for the embezzlement.

I got $780 back. The court just shrugged its shoulders. :rolleyes:

Count #1 was essential a summary of the scheme. Count #4 was a class 3 felony in the amount of $4,500.00. Got 3.5 years for count 3. Still not enough.

For sure, I mean so much effort to keep the house of cards from falling for that long. Could have made a solid living by the books with similar effort.

I’d be fuckin BUUUUUUUMMED if I went to prison man. I mean, you make the best of it but I just LOVE my freedom too much. And the ability to do what I want when I want. It would seriously screw with my head to have that taken away. I think that would be the worst part. I’ve spent myfair share of time locked in the cage (on the other side). Life gets to be normal. But the lack of freedom would drive me crazy.

I housed him yesterday, he got a corner cell upstairs, probably has no view of the TV or outside windows.

He is DOC property already and will serve the full 85%. The remaining 15% is the parole time. First stop on the DOC train is Alhambra, for their classification. That's usually about a month then most likely back out to the Kingman yard to finish. ADOC has a good site for inmate searching and staying up to date
