I barely saw the news clip, so don't know much of the story, but....

More than likely, the group was given an official announcement that they were an unlawful assembly, were given ample time to disperse. You want an ample time? Try at least 20 minutes, I'd wager it was an hour, these kids wanted to be arrested most likely for their cause.

I've moved a few folks like this in my time, pressure points, getting the right leverage, and you can undo any human chain quickly, looks not too violent on TV, and the protesters usually don't want anything to do with being "moved" by us next time around.

Problem with that? Lawsuits. While few lawsuits could show permanent, or even minor injury from the pressure point/leverage movements, cities still payed out.

Enter OC spray. Looks bad on TV, but in the end, little contact, or at least little physical force has to be used on a college kid who is balling their eyes out, and, more importantly, ready to un ass and move.

OC spray has equaled less lawsuits, =less tax dollars paid out for enforcing the law.


Shoot the messenger here all you want, really don't care any more, you'll call me just the same when a bomb is located, but feel free to open the container yourself, since those that know all about police work know render safe procedures:skull. I'll just clean up what's left of you....:thumbsup

These worthless, lazy, anarchistic pieces of human debris are costing taxpayers a fortune with their antics. Short of shipping them all to Ethiopia, or some other socialistic paradise where they all long to be, wasting perfectly good pepper spray on them is, well, a waste of product.
I would absolutely love it if we could find room in our county jails for them to do a year, but since that won't work, how about having them fill all the jobs picking fruit in the fields when we send the illegals home?

These people are the direct result of the protesters of the 60's being allowed to breed, and then letting them take over our higher education system where they have spent the last 3 decades plucking the most vulnerable of the youth and teaching them that life is not their fault, that the country owes them, that working for a living is beneath them, and that the U.S. is evil.
We have reaped what we allowed to be sown.

Refusing to move after being given vergal warning is resisting. Passive vs agressive but resisting non the less. And as LR2 already pointed out, there is a much greater chance of physical injury to all involved if the cops have to go hands on.

On a serious note, failure to obey the command to disperse after a lawful declaration of unlawful assembly is resistance, and a crime. since i am very familiar with the Peoples Republik of Davis, I can guarantee you that the cops were operating under strict rules of engagement, and had been directed to end the matter.
They know they were going to bring the ACLU types in, and that is why they followed their policy on escalation of force to the letter. I would submit that the cops had their own folks there recording the incident, probably from more than one angle, and that the media is showing is the least accurate representation of what happened.
The deployment of OC via that large canister is standard operating procedure in crowd control events, and while the officer that deployed the spray might have gotten lower, it would have put him at risk for being spit on, or had some substance thrown at him.
He is not required to present himself as a target to deploy a chemical agent.
The only way the officers lose in this event is if the city or university does not back them up. Since Davis is famous for not backing it's officers in any matter, they went in knowing that, and will fall back on written policy, which they are well within.
If they are within policy, the hiring authority must back them in any civil litigation.
I understand that so far, no one who has posted has hammered on the cops in this event, there are just questions, and concern over the deal.
In all candor, tho, the people of this country are very soon going to have to decide where the lines are. These occupy people are trampling on the honored past of civil disobedience. MLK got his point across and did not create a hazmat disaster in his wake, leaving raw sewage, needles, condoms, etc. in his wake as they are doing in NYC and Oakland.
These people are way beyond civil.
We are reaching a point where redefining acceptable public behavior is going to be necessary..as I said in my first post, if you wonder where these people came from and how they could be so completely out of touch with the country, look no further than the liberal education system that has been churning them out for 3 decades.

3 easy ways come to mind:
1. Parents- they go home at night or parents bring food down
2. Donors: There is free food every day, organized with backing by some annonymous donors, happens with a lot of protestors in LA
3. Part time workers/protestors, they stay part of week work starbucks, book stores the other half.

All of the above have been confirmed, 20% of the tents are actually occupied at night per our Airship's FLIR, on several checks.

As far as the pepper spray, that's exactly what happens when you do not do what a LEO legally tells you to do.

The students I know are too busy with their social lives when and if they have any free time from school or work. Not to mention all the 20something year old I know could give a shit less about anybody besides themselves. I can't imagine any of them taking a stand and inconveniencing themselves for any type of social issue.

My best guess is that the protesters are straight up homeless using this protest as an excuse to stay somewhere. It may not have started this way however.

As for the pepper spray, if they were told to leave and they refused. I say remove them by any means necessary.

They were greeted by Occupy SD protesters shouting Fuck you at all the moms walking into and out of the show with little kids. SD PD kept them corraled, but really? Your point as protesters is to shout fuck you at moms and toddlers? Have a nice life wondering why you can't get a job.
