I’m n a bad situation right now. My doctor has been ignoring me for the past 6 years. I’ve been complaining that I can’t walk and he always says nothings wrong. My last visit in January I told hm again and I was wheelchairEd into his office I told hm doc i can’t walk and again he told me I was fine. So at this point I took matters into my own hands. Stopped taking blood pressure medication got my pressure up and off to the ER, I wanted a legit reason to be there. ER immediately knew what was going on. They ordered an EKG and a a I think CT scan. Bam all my arteries were blocked,aorta and all. Now they are scratching their heads wondering how they are going to fix it. Yes a VA doctor and yes I can sue him. I’m interested in if anyone has ever filed a medical malpractice suit and got a settlement. Any thoughts are appreciated.😎

Not many attorneys will touch medical malpractice and even less do it well.

What state? CA has a cap on recovery that is hard to get around. The litigation is usually more expert intensive and thus, pretty expensive.

Good luck in California. A family member was given an OD of chemo meds by the hospital that caused cardiac arrest. He was placed in ICU and died days later. Hospital admitted mistake. Couldn't find an attorney willing to take the case.

Their is law firms that will take it, I found several that specialize in VA suits. All I can do is try.😎

I explored this after some dipshit doc sewed my toe back on (against my wishes) and didn't put the bone back together....just left it flopping around in there so it died.
Have a good friend who's an attorney who hooked me up with a guy he went to school with that does malpractice....said it's pointless. From what I was told, the State of CA has a limit of $250K for malpractice.....and that $250K is for serious shit, like....you got wheeled out as a quadriplegic or something along those lines. He explained that the bar is set at $250K for that type of injury resulting from malpractice, and where I think mine lies in relation to that. He said I'd probably be lucky to get a $5-10K judgement, and I would likely pay him that much or more to get it.

You're dealing with the VA though...so the rules might be different.

You're dealing with the VA though...so the rules might be different.
When I lost my finger on the truck, there was a literal chart. It looked like a butcher's diagram, showing what appendage or digit was worth what. There were also "bonuses", if it were your dominant hand or what not.
A ring finger from the left hand, from a right handed person, was worth 1300$

A billion dollar a year outfit was nice, paid it without even a suit...in three F'n payments!

Did you ever sign papers at the doctor's office agreeing to arbitration? This is one of those pages we all sign, and really makes attorneys back away.

With the VA you'll need to file a Tort Claim. You can't just "sue" the Government, or their employees (for official duties).
Most VA lawyers you'll see advertised out there specialize in overturning VA denials or getting increased benefits, not malpractice stuff.

Suing the Government is a niche corner in the legal world. Find a lawyer who specializes in medical malpractice at VA (or IHS) facilities. Your average ambulance chaser won't have a clue.
